TERMS OF USE

1. Scope

These Terms of Use apply to the website scordalus.com (“Website”), operated by Creativium LLC, 30 N Gould St Ste N, Sheridan, Wyoming 82801, USA (“we”, “us”). They cover your use of the Website and anything you send us through it (tributes, reaction links, press links, sign-ups). Purchases in our merch shop are made with Spreadshirt under Spreadshirt's own terms. The paid Inner Circle membership will have its own terms, which we will show before you can subscribe.

2. AI Transparency

Scordalus is a virtual band. Avena Morr, Ravyn Vex, Nyra Vanthe and Kaida Noctis are fictional characters. Our music, vocals, band photos, artwork and music videos are created by real people with the help of AI tools. They do not show real persons or real events. Any resemblance to real persons is unintended.

3. Using Our Content

You may listen, watch and share links to our pages and official videos. Downloading, copying or re-uploading our music, images or videos, or using them commercially, requires our written permission – unless the law allows it (e.g. quotation) or a page says otherwise (e.g. wallpapers for personal use in the members area). Media from our Media Kit may be used for reporting about Scordalus. Please do not use our name, logo or characters in a way that suggests we endorse something.

4. Your Tributes (Fan Submissions)

When you send us a tribute (photos of tattoos, figures, patches, artwork or fan photos), the following applies:

• Age: You must be at least 16 years old.
• Your rights: You confirm that you created the work and the photos, or that you have the permission of the creator and the photographer, and that the work does not infringe anyone else's rights.
• People in the photos: If people can be recognised – for example the person wearing the tattoo – you confirm that they agree to the publication. Please do not send photos showing children.
• Permission you give us: You allow us, free of charge and non-exclusively, to show your photos, title and credit on our Website (Tributes page and preview on the start page), to resize and crop them, and to remove metadata. We do not use them for advertising or on other channels without asking you first. You keep all your rights and can keep using your work as you like.
• Credit: We credit you with the name or handle you give us, or anonymously if you leave it empty.
• No obligation: We decide freely whether to publish a submission. There is no payment and no claim to publication.
• Removal: You can ask us to remove your tribute at any time by email. We will then delete it from the Website and from our storage without undue delay. Your permission ends with the removal.
• Not allowed: illegal, hateful, violent, sexual or discriminatory content, content showing other people without their consent, and advertising.

Reaction videos and press articles you send us as links stay with their creators. We only embed or link to them and may write our own short summary.

5. Reporting Content (Notice & Takedown)

If you think content on our Website infringes your rights (e.g. copyright, your image or privacy) or is otherwise illegal, email us at Show email and include:

• the page address (URL) and which content you mean,
• why you think it is unlawful or infringes your rights,
• your name and email address (not needed for reports about child sexual abuse material),
• a statement that your report is accurate and complete to the best of your knowledge.

We will review every notice promptly and diligently, remove or block content that is unlawful, and inform you and – where possible – the person who submitted the content of our decision and the reasons. If we remove your submission, you can contact us to ask us to reconsider.

6. Forms and Fair Use

Please use our forms only for their purpose. To prevent spam we limit how often a form can be used and may block automated or abusive submissions. Only enter your own email address in the Inner Circle notification form.

7. Advertising & Third-Party Links

Our Dark Deals page contains advertising in the form of affiliate links and banners. If you buy through them, we may receive a commission at no extra cost to you. Contracts for these products are concluded only with the respective seller. We are not responsible for the content of linked or embedded third-party sites.

8. Liability

The Website is provided free of charge and “as is”. We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are only liable for breach of essential obligations and limited to typical, foreseeable damage. Mandatory consumer protection laws remain unaffected.

9. Changes and Applicable Law

We may update these Terms for the future, for example when we add new features. The version shown here applies. The laws of the State of Wyoming, USA, apply. If you are a consumer, you keep the protection of the mandatory laws of the country where you live.
